Social Trainers Award error amended the Commission

We recently received correspondence from the Department of Communities stating that an error was made in 2009 when the Social Trainers Award 1988 was amended at the Industrial Relations Commission. We have looked at the issue and agree that 2 subclauses were deleted in error. The Department have requested an Award variation to rectify the situation and bring the Social Trainers Award in line with the Public Service Award 1992. 

The CSA are happy to accept the Award variation to include the deleted subclauses, however, we would like to provide you with details just in case there are any objections or comments. If you would like to provide feedback please email any queries through to [email protected] . If we do not receive any objections we will consent to the Award variation. 

The deleted clauses are:

Clause 22 Annual Leave 

3       (b) an employee may take annual leave during the calendar year in which it accrues or anytime thereafter, but the time during which the leave may be taken is subject to the approval of the employers. 

        (c) an employee who has been permitted to proceed on annual leave and who ceases duty before completing the required continuous service to accrue the leave, must refund the value of the unearned pro rata portion, calculated at  the rate of salary as at the date the leave was taken, nut no refund is required in the event of the death of an employee.

These exact subclauses remain in the Public Service Award.
